Scope of Services: DVLCA4PLM Implementation and Support

This section outlines the scope of services included with the DVLCA4PLM product offering.

I. Included Services

The following services are included in the standard DVLCA4PLM package and will be delivered as part of the implementation:

  1. Requirements Gathering:
    • Collaborative workshops and sessions to define specific customer needs and requirements relating to the DVLCA4PLM implementation.
  2. Core Installation and Configuration:
    • Installation of the DVLCA4PLM OOTB (Out-of-the-Box) server.
    • Configuration of the frontend interface for streamlined user access.
  3. DVLCA4PLM Custom Configuration:
    • Tailoring of the DVLCA4PLM platform to align with customer-specific requirements, including:
      • Data Model Deployment: Implementing a customized data model to effectively manage product information within PLM product.
      • Active Workspace (AWC) Deployment: Customizing the frontend user interface to reflect the defined data model and user roles.
      • Workflow Handler Installation: Setting up automated workflow handlers to support business processes.
      • Scheduler Installation: Configuring the job scheduler for automated tasks and data processing.
      • Result Uploader: Enabling automated upload of analysis results and reports into PLM Product.
  4. Training and Support:
    • Up to four (4) weeks of dedicated support, which can include:
      • Training: Hands-on training sessions for administrators and end-users on DVLCA4PLM functionalities and best practices.
      • Consultation: Expert guidance on optimizing DVLCA4PLM utilization and configuration for maximum efficiency.
      • Configuration Support: Assistance with fine-tuning system configurations and addressing any issues encountered during the evaluation phase.
  5. System Deployment:
    • Installation of the DVLCA4PLM software on up to two (2) designated client systems.

II. Excluded Services (Out of Scope)

The following services are not included within the standard DVLCA4PLM package and may be available under a separate agreement:

  1. Custom Business Processes and Documentation:
    • Development or modification of customer-specific business processes, procedures, or documentation beyond what is explicitly agreed upon during the initial requirements gathering phase.
  2. Performance Metrics and System Guarantees:
    • Specific guarantees regarding system performance metrics (e.g., system availability, scalability), as well as compliance with non-functional requirements (performance, security) are not included unless explicitly defined and agreed upon in a separate Service Level Agreement (SLA).
  3. Custom Software Development:
    • Development of custom software solutions or extensions not explicitly specified and agreed upon in a separate statement of work.
  4. Third-Party Integrations:
    • Integration with third-party software systems not explicitly defined and agreed upon in a separate statement of work.
  5. Data Migration and Cleansing:
    • Data cleansing, transformation, or migration from legacy systems is not included in the standard package. These services can be provided under a separate agreement.

III. Assumptions

  • The customer will provide timely access to necessary personnel, systems, and information required for successful project execution.
  • Any prerequisites for installation and configuration (e.g., hardware, operating systems, database software) will be met by the customer prior to the start of the engagement.
  • Any changes that will impact the scope will be discussed with the customer and documented.
  • If travel is required, customer will cover any travel costs.

IV. Acceptance

  • The customer agrees to review and approve all documentation.
  • Acceptance criteria will be mutually agreed upon prior to the commencement of each phase.

Acceptance Procedure

  • Acceptance is confirmed in writing using the acceptance form.
  • DVCS will notify the customer when a component is ready for acceptance.
  • The customer will inform DVCS within two weeks if a component delivery does not meet the acceptance criteria, providing detailed reasons for the non-acceptance.
  • If DVCS does not receive acceptance or rejection from the customer within two weeks, the component delivery will be considered accepted by default.
  • The project will be considered complete when all components or services have been delivered and accepted by the customer.

    • Preferences
    • Custom Handlers
    • Custom Utilities

  • Installation of DVLCA4PLM Scheduler
  • Integration of ecoinvent database
  • Training and Support for four weeks
    • Usage and concepts used in the product
    • Workflow to initiate the calculations
  • Mapping of all Legacy materials to PLM Product
  • Mapping PLM Materials with ecoinvent activities
  • Mapping PLM  Materials with Customer BOM Objects (Design)
  • Demonstrate on how to calculate the CO2
    • Material Creation
    • Material to ecoinvent activity mapping
    • LCA process creation and mapping of flows/processes/activities
    • Initiating CO2 emission calculation
    • Reading the CO2 emission dashboard.

* Note: The stated price is for the DVLCA4PLM application license only. Additional services will be quoted separately based on a detailed assessment of customer requirements.

Warranty

  • The warranty for the product provided by DVCS is valid as long as the Annual Maintenance Contract (AMC) is active. When the AMC expires, the warranty coverage also ends unless the contract is renewed.
  • DVCS is not responsible for damages caused by customer actions, including but not limited to inappropriate use, maintenance, repair, or unauthorized modifications not performed by DVCS.

Limitation of Liability

  • DVCS shall be liable without limitation for personal injury for which it is responsible and in the event of property damage for which it is responsible shall reimburse the expenses for the restoration of the goods up to a maximum amount equal to the contractual value of this SOW. This does not include expense of recovering lost data and information.
  • Further claims for damages and reimbursement of expenses, regardless of the legal grounds, in particular due to breach of obligations arising from the contractual relationship are excluded. This applies in particular to claims for consequential damages such as lost profits, business interruption, loss of use, loss of interest, loss of information, and data or contractual claims.
  • The statutory limitation period for claims for damages against DVCS is twelve (12) months from the statutory start of the statute of limitations, unless the damage was caused intentionally. In the case of claims for damages under the Product Liability Act, the statutory statute of limitations applies.

Force majeure

  • DVCS and the customer shall continue to perform the obligations of the SOW after the termination of the Force Majeure Event or its consequences. The duration of the SOW will be extended accordingly.
  • A Force Majeure Event shall not relieve a party of liability for any obligation that arose prior to the occurrence of such Event, nor shall such Force Majeure Event affect the obligation to timely pay any compensation due prior to the occurrence of such Force Majeure Event. All professional services provided are due for payment until and during the occurrence of Force Majeure.

Data protection

DVCS will be responsible for the lawfulness of the collection of all personal data it collects. It is obliged to provide the data subjects with the relevant mandatory information in accordance with Art. 13 and 14 GDPR.

The contracting parties undertake to treat all information received in the course of the upgrade as strictly confidential and to disclose personal data only for the agreed purpose of the upgrade. Each contracting party shall comply with the statutory provisions on data protection and take the necessary technical and organizational measures to protect this data.

The employees of the contracting parties involved in data processing shall be obliged to comply with data protection.

License and Ownership of Work Result

  • Each party keeps all rights to any software, ideas, tools, techniques, and other proprietary materials or information they owned or created before or after starting this SOW, as long as it was done without using the other party’s intellectual property.
  • Software and technology licensed from third parties remain the property of those vendors.
  • Updates provided under this Agreement are not considered “works made for hire” under copyright law.
  • Unless stated in this Agreement, neither party grants any license to its patents, copyrights, trade secrets, or other intellectual property.
  • If DVCS’s work infringes third-party rights and the customer faces claims for using the DVLCA4PLM, DVCS will cover these claims, including legal costs and attorneys’ fees.
